1. Our Platform and Services
We operate the Ministerio AI platform (the “Platform”), which provides artificial intelligence-powered tools to assist Christian leaders and pastors in creating and organizing sermons and resources. These Terms constitute a legally binding agreement between you and Ministerio AI regarding your access to and use of the Services.
2. Intellectual Property Rights
Unless otherwise indicated, the Platform is our proprietary property, including all source code, databases, functionality, software, designs, audio, video, text, and graphics. You are granted a limited license to use the platform. You retain the rights to any texts or ideas you input into our service.
3. User Representations
By using the Services, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information; (3) you have the legal capacity to agree to these Terms; (4) you are not a minor; and (5) your use of the service will not violate any applicable law.
4. User Registration
You may be required to register with the Services. You agree to keep your password confidential and will be responsible for all use of your account.
5. Fees and Payment
We offer free and paid account options (the “Subscriptions”). We bill you for Subscriptions through an online billing account. You agree to provide current, complete, and accurate purchase and account information. Subscriptions automatically renew at the end of each cycle.
6. Prohibited Activities
As a user, you agree not to: systematically retrieve data to create databases; circumvent security features; use the service to advertise unauthorized commercial sales; or use automated scripts (bots or scrapers) to interact with the platform.
7. Third-Party Websites and Content
The Services may contain links to third-party websites or content. We are not responsible for any third-party content accessed through the platform, and we do not investigate, monitor, or check such sites for accuracy.
8. Services Management
We reserve the right, but not the obligation, to: monitor for violations; take appropriate legal action against anyone who violates these terms; and manage the platform to protect our rights and ensure its proper functioning.
9. AI Fair Usage Policy
Our plans may include unlimited or high-volume AI generations designed for normal ministry use. We monitor usage patterns and reserve the right to rate-limit or restrict generations if usage places an undue burden on our technical infrastructure or AI providers.
10. Privacy Notice
We care about data privacy. By using the Services, you agree to our Privacy Policy, which governs the processing and security of your personal information.
11. Copyright ACT Notice and Policy
We respect the intellectual property rights of others. If you believe that any material available through the Services infringes upon any copyright you own, please notify us immediately for proper evaluation and removal if needed.
12. Term and Termination
These Terms shall remain in full force and effect while you use the Service. We may terminate or suspend your access or delete your account for any reason, without notice, if you breach these Terms or our fair usage policy.
13. Modifications and Interruptions
We may change or remove the platform or service at any time. We will not be liable for any modification, price change, or suspension. We cannot guarantee the platform will always be available without delays or server system errors.
14. Governing Law
These Terms are governed by the laws applicable to agreements made and interpreted in the jurisdiction where Ministerio AI holds its legal registration, without regard to potential conflict of law principles.
15. Dispute Resolution
To expedite resolution and control costs, the parties agree to informally negotiate any dispute arising from these Terms for at least 30 days before initiating mediation or arbitration proceedings.
16. Corrections
There may be information on the Services that contains typographical errors, inaccuracies, or omissions regarding pricing, descriptions, or availability. We reserve the right to correct any erroneous information at any time.
17. Disclaimer
THE SERVICES ARE PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. AI IS AN ASSISTIVE TOOL AND WE DO NOT CERTIFY THE THEOLOGICAL INFALLIBILITY OF ITS GENERATIONS. WE DISCLAIM ALL IMPLIED WARRANTIES.
18. Limitations of Liability
IN NO EVENT WILL WE OR OUR DIRECTORS BE LIABLE FOR INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM USE OF THE PLATFORM. OUR TOTAL LIABILITY SHALL BE LIMITED to the amount paid by you in the prior six months.
19. Indemnification
You agree to defend, indemnify, and hold us harmless from any loss, damage, or third-party claim arising out of your use of the Services or breach of these terms or third-party rights.
20. User Data
We will maintain certain data related to platform performance. Although we perform routine backups, the responsibility for data loss or damage of the information and texts stored falls entirely on the user.
21. Electronic Communications and Signatures
Visiting the website and completing online purchases constitutes an electronic communication. You agree to electronic delivery of notices, records, and policies via this digital medium.
22. California Users and Residents
If any complaint is not satisfactorily resolved with us, California residents can contact the Complaint Assistance Unit of the Division of Consumer Services in California per applicable laws.
23. Miscellaneous
These Terms and any policies posted constitute the entire agreement between you and us. Our failure to enforce our stance on any clause does not imply a subsequent waiver of such rights.
